Fiji presently uses Trade Marks Act 1933.

The Fiji Intellectual Property Office (“FIPO”) operates manually and the trade marks data is not digitised.

Fiji only has provision for registration of goods and not service mark registration.

Application for registration can be filed independently.

Fiji does not follow the NICE classification of goods and still uses the old United Kingdom (“UK”) classification. This can be provided on request.

UK registrations are allowed to be filed and registered as of right, however, there is a requirement to publish the application for notification purposes.

A registered trade mark is valid for 14 years in Fiji and can be renewed for the same term on each subsequent expiry. Fiji provides for recordal of changes, assignment and merger at FIPO by application and payment of necessary fees.

Any activity at FIPO by our firm must be conducted with an Authorisation of Agent which will provide on request.
